1. Introducción

Turpal Technologies FZCO ("Turpal", "nosotros", "nuestro" o "nos") ha desarrollado la aplicación Turpal como una aplicación comercial. Estamos dedicados a proteger y respetar tu privacidad. Esta política detalla nuestras prácticas respecto a la recopilación, uso y compartición de tu información personal. Al usar nuestro Servicio, aceptas la recopilación y uso de información de acuerdo con esta política.

2. Definiciones

Los términos utilizados en esta Política de Privacidad tienen los mismos significados que en nuestros Términos y Condiciones, que están disponibles en Turpal, a menos que se definan de otra manera en esta Política de Privacidad.

3. Recopilación y Uso de Datos

Datos Personales: Podemos pedirte que nos proporciones cierta información personal identificable para mejorar la experiencia del usuario. Esto podría incluir, pero no se limita a, tu nombre, número de teléfono y ubicación.

Datos de Uso: En caso de error en la aplicación, recopilamos datos e información de tu dispositivo, denominados Datos de Registro. Esto podría abarcar detalles como la dirección IP de tu dispositivo, nombre del dispositivo, versión del sistema operativo, configuración de la aplicación durante el uso, marcas de tiempo y fecha, y otras estadísticas.

Datos de Terceros: Nuestra aplicación incorpora servicios de terceros, como Google Play Services, que pueden recopilar datos sobre ti.

4. Cookies

Nuestro Servicio puede utilizar "cookies" indirectamente a través de integraciones de terceros. Las cookies son archivos almacenados en tu dispositivo que rastrean las interacciones del usuario y recuerdan las preferencias del usuario. Los usuarios tienen la opción de aceptar, rechazar o ser notificados cuando se envía una cookie a su dispositivo.

5. Base Legal para el Procesamiento de Datos

Procesamos tus datos en base a:

Tu consentimiento explícito;
La necesidad para la ejecución de nuestro contrato;
Cumplimiento de nuestras obligaciones legales; y
Intereses comerciales legítimos.

6. Proveedores de Servicios

Trabajamos con terceros:

Para habilitar ciertas funciones;
Para proporcionar y apoyar nuestro Servicio;
Con fines analíticos para entender la interacción del usuario.

Estos terceros tienen acceso a tus datos personales pero están obligados a no divulgar o usarla para otros fines.

7. Seguridad de los Datos

Valoramos tu confianza al proporcionarnos tu información personal. Adoptamos medidas estándar de la industria para protegerla, pero recuerda que ningún método de transmisión en línea o almacenamiento electrónico es 100% seguro.

8. Retención de Datos

Mantenemos tus datos personales solo durante el tiempo necesario, tal como se detalla en esta Política de Privacidad.

9. Derechos sobre los Datos

Bajo el GDPR, tienes el derecho a:

Acceder, corregir o eliminar tus datos personales;
Oponerte a nuestro procesamiento de datos;
Portabilidad de datos; y
Retirar tu consentimiento.

10. Enlaces a Otros Sitios

Este Servicio puede contener enlaces a otros sitios. Hacer clic en un enlace de terceros te llevará a ese sitio. Te recomendamos que revises sus Políticas de Privacidad ya que no las controlamos.

11. Privacidad Infantil

Nuestro Servicio no está dirigido a menores de 13 años. No recopilamos conscientemente datos de niños menores de 13 años. Si un padre/tutor se da cuenta de esto, por favor contáctanos.

12. Cambios en Esta Política de Privacidad

Podemos modificar esta política ocasionalmente. Por favor revisa esta página regularmente para mantenerte actualizado.

13.4 Scheduled maintenance

Turpal will use reasonable efforts to perform scheduled maintenance outside business hours and to give advance notice of any maintenance expected to cause material unavailability.

14. Third-Party Services

14.1 The Services may interoperate with or be used alongside services provided by third parties (“Third-Party Services”). The Customer’s use of any Third-Party Service is subject to that provider’s terms and is solely between the Customer and that provider.

14.2 Turpal is not responsible for, and gives no warranties in respect of, any Third-Party Services.

15. Changes to these Terms

15.1 Turpal may update these Terms from time to time. The current version is always published on Turpal’s website with an “Effective date” and version number.

15.2 Turpal will notify the Customer (by email to the address on the Order Form, or by in-product notice) of any material changes at least 30 days before they take effect.

15.3 If a material change is materially adverse to the Customer, the Customer may terminate the Agreement on written notice given before the change takes effect, in which case Turpal will refund any prepaid Fees for the period after the termination date.

15.4 Continued use of the Services after the effective date of an updated version constitutes acceptance of the updated Terms.

16. Notices

16.1 Notices to Turpal must be sent to legal@turpal.com (with a copy to farshid@turpal.com).

16.2 Notices to the Customer will be sent to the email address on the Order Form, or to such other address as the Customer notifies in writing.

16.3 Notices are deemed received on the next business day after sending if sent by email, or on actual receipt if delivered by hand or courier.

17. General Provisions

17.1 Force majeure. Neither party is liable for any failure or delay in performing its obligations (other than payment) caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, government action, internet outages, or pandemics.

17.2 Assignment. Neither party may assign or transfer the Agreement without the other party’s written consent, except that either party may assign the Agreement (in whole) to an affiliate or to a successor in connection with a merger, acquisition or sale of substantially all its assets.

17.3 Independent contractors. The parties are independent contractors. The Agreement does not create any agency, partnership, or joint venture.

17.4 Entire agreement. The Agreement is the entire agreement between the parties on its subject matter and supersedes all prior or contemporaneous agreements, communications and understandings.

17.5 No waiver. A failure or delay to exercise any right under the Agreement is not a waiver of that right.

17.6 Severability. If any provision is held invalid or unenforceable, the remaining provisions will continue in full force.

17.7 No third-party rights. The Agreement does not create any rights in favour of any person who is not a party to it.

18. Governing Law and Jurisdiction

The Agreement is governed by and construed in accordance with the laws of the United Arab Emirates, as applicable in the Emirate of Dubai. The parties submit to the exclusive jurisdiction of the courts of Dubai for any dispute arising out of or in connection with the Agreement.

19. Order of Precedence

If there is any conflict or inconsistency between the documents that make up the Agreement, the order of precedence is:

• The Order Form (for commercial terms);

• Any Data Processing Addendum (for personal data matters);

• These Terms;

• Any other policy or schedule incorporated by reference.
